1. Agreement to Terms

By accessing or using Virixy Privacy AI ("Service"), a browser extension and web dashboard operated by Virixy Inc ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). The Service provides comprehensive privacy protection through 6 powerful features: AI-powered privacy policy analysis, security scanning, tracking detection, cookie management, opt-out helper, and privacy automation. If you disagree with any part of these terms, then you may not access the Service.

2. User Accounts

2.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your password and identification
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

2.2 Account Responsibility

You are responsible for safeguarding the password and for all activities that occur under your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity, or a name that is otherwise offensive, vulgar, or obscene.

2.3 Account Termination

We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof) at any time for any reason, including but not limited to breach of these Terms.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit any malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission
• Use the Service for any illegal or unauthorized purpose
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

4. Subscription Management

4.1 Subscription Plans

The Service offers both free and premium subscription plans. The free plan provides access to all 6 features (AI policy analysis, security scanning, tracking detection, cookie management, opt-out helper, and privacy automation) with a limit of 2 domains per feature per month. Premium subscriptions are billed on a monthly basis ($5/month) and provide unlimited access to all features across all domains.

4.2 Billing and Payment

Subscription fees are processed through Paddle, our payment processor. By subscribing, you agree to:

• Pay all fees associated with your subscription
• Provide accurate billing information
• Authorize Paddle to charge your payment method
• Accept that subscription fees are non-refundable except as required by law or as stated in our Refund Policy

4.3 Subscription Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings or by contacting us at billing@updates.virixy.com.

4.4 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will be communicated to you at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to premium features until the end of your paid period.

5. Service Features and Usage Limits

5.1 Available Features

Virixy Privacy AI provides 6 core privacy protection features through both the browser extension and web dashboard:

• AI-Powered Privacy Policy Analysis: Instant analysis of privacy policies with AI-generated insights
• Security Scanning: Domain security vulnerability scanning and assessment
• Tracking Detection: Real-time detection of third-party trackers and data collection
• Cookie Management: Smart cookie consent management and preferences
• Opt-Out Helper: Assistance with opting out of data sharing and tracking
• Privacy Actions: Automated privacy action recommendations and automation

5.2 Usage Limits

Free plan users are limited to 2 domains per feature per month. Each feature (AI policy analysis, security scanning, tracking detection, cookie management, opt-out helper, and privacy actions) has its own independent limit. Premium subscribers receive unlimited access to all features across all domains.

6. Intellectual Property

The Service, including the browser extension, web dashboard, and all original content, features, and functionality, are owned by Virixy Inc and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service or browser extension without prior written consent.

7. User Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to grant the license described above and that your User Content does not violate any third-party rights.

8. Liability Limitations

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRIXY INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

7.3 Maximum Liability

IN NO EVENT SHALL VIRIXY INC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY.

9. Indemnification

You agree to defend, indemnify, and hold harmless Virixy Inc and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Termination

9.1 Termination by You

You may terminate your account at any time by contacting us at help@updates.virixy.comor through your account settings.

9.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

9.3 Effect of Termination

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Virixy Inc operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
